• "Zindara", "we", "us", or "our" refers to the residential elderly care facility operating at 8/15 Soi Nimmanhemin 9, Suthep, Mueang Chiang Mai, Chiang Mai 50200, Thailand.
• "User" or "you" refers to any individual accessing our website or making an enquiry about our services.
• "Services" refers to the residential and companionship care services described on this website.
• "Agreement" refers to any formal care arrangement entered into between Zindara and a client or family representative.
• "Website" refers to the website operated by Zindara at the domain zindareness.

2. Acceptance of Terms

By accessing or using this website, you confirm that you are at least 18 years of age, have the legal capacity to enter into binding agreements, and accept these Terms & Conditions in full. If you do not accept these terms, please discontinue use of the website immediately.

3. Service Description

Zindara provides residential and companionship care services for elderly individuals. Our three current service tiers — Evening Companionship, Residential Wellbeing, and Clinical Comfort Residence — are described on our Solutions page. Service availability is subject to room availability and care suitability assessment.

Information on this website is provided for general guidance only. Specific terms of any care arrangement, including pricing, scope, and conditions, are set out in the individual care agreement signed by both parties at the time of admission.

Services are available to residents and families based in Thailand. International families are welcome to enquire; care arrangements with residents from abroad are subject to standard admission assessment.

Care Arrangements

All residential care placements at Zindara require a pre-admission assessment and the signing of a formal care agreement. The care agreement sets out the scope of services, fees, payment terms, and conditions for adjustment or termination of the arrangement.

Fees and Payment

Monthly fees are stated in Thai Baht (฿) and are due as specified in the individual care agreement. Fees are reviewed periodically; families will be given reasonable advance notice of any changes. Applicable fees are set out during the pre-admission discussion and confirmed in writing.

Refund Policy

Refund terms for advance payments and deposits are governed by the individual care agreement. Generally, unused portions of prepaid monthly fees are refunded proportionally upon written termination of a care arrangement with the required notice period, as specified in the agreement.

This website and its content are provided on an "as available" basis for informational purposes. While we take care to keep information accurate and current, we make no representations or warranties regarding the completeness or accuracy of content at any given time.

8. Limitation of Liability

Our liability in connection with direct damages arising from use of the website shall not exceed ฿10,000.

This limitation does not apply to liability arising from personal injury caused by our negligence, or to any liability that cannot be lawfully excluded under Thai consumer protection law.

You agree to indemnify and hold Zindara harmless from any claims, losses, or expenses arising from your breach of these Terms & Conditions or from any misuse of the website, to the extent permitted by applicable Thai law.

Care arrangements may be terminated by either party in accordance with the terms of the individual care agreement. Provisions of these Terms & Conditions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) shall do so.

11. Dispute Resolution

These Terms & Conditions are governed by the laws of Thailand. In the event of a dispute arising from the use of this website or from these terms, we encourage resolution through direct communication in the first instance. Disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Chiang Mai Province, Thailand.

12. General Provisions

• Entire Agreement: These terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Zindara with respect to use of this website.
• Severability: If any provision of these terms is found unenforceable, the remaining provisions shall continue in full effect.
• Waiver: Failure to enforce any provision of these terms shall not constitute a waiver of the right to do so in the future.
• Assignment: You may not assign your rights or obligations under these terms without Zindara's written consent.
